I did some testing and either I'm supremely unlucky or there are mechanics in play beyond it being possible to find on 1 of 3 traders. Over 45 inventory refreshes EACH for Arron and Roah (in Moonrise, not goblins) using the level-up trick, including doing all 4 players simultaneously, and it never showed up. It might be randomly designated to a specific merchant per game, or it might be linked to another item (like charged hammer) and you can only get one of the two, or it could be something else. Like supremely bad luck. I even loaded a save before I left the main Act 1 area (other than the underdark), did one more round of level-up inventory resets (including Roah in goblins), and still no dice.

Saw another reported trader: Brem in the Zhentarim hideout...but no saves going back that far. Brem is dead as a can of spam.

Can confirm, found in Grat the Trader's shop in the Goblin Camp, this item seems extremely RNG to find. I booted up a brand new file and ran straight there and found it

This is now damage with a spell, not damage in general. My dreams of dealing 1 extra fire damage were shattered when I saw this update ingame.

Seems to work on fire, acid, poison surfaces.
Ice,water, grease, web didn't work for me

In short, surface that applies a finite status effect works.

Tried with throwing bottle of water under my feet, then Call Lightning on the enemy. The Wet status is sadly not applied.

A cool thing I just tested is that as a Sorc, if you twinspell Chromatic orb: poison, and place the first one at your feet and the 2nd one at your target of choice, it'll proc this item possibly poisoning them AND putting toxin on them in the same hit, really cool for setting up all your other spells to inflict toxin on everything else

This seems extremely potent for applying the effects, it doesn't give them a saving throw, it will just auto apply it on-hit, stand in the puddles and cast the biggest aoe and watch em all suffer lol

Either bugged or only work with very specific surfaces. Tried with electrocuted water surface, didn't apply the jolt/electrocute DoT.

FWIW, the location seems to be no longer accurate as of full release, but I'm uncertain of the details. On a multiplayer game I'm in I found it for sale by Grat The Trader in the Goblin Camp, but in my single-player game he wasn't selling it, and neither was Arron, Roah Moonglow, or Volo (the latter two I checked due to the variability in location for The Whispering Promise). Seems there's a bit of randomness to its location.

This only works with fire, acid, poison and caustic brine It is very good when paired with magic missile, let your wizard cast a chromatic orb of acid or poison, then stand in it with your Eldritch knight and use magic missile to apply poisoned or acid to 3 enemies for 2 turns each
